Facts:
Appellant mother appealed an order of the Circuit Court of Fairfax (Virginia) terminating her parental rights to her daughter pursuant to Va. Code Ann. § 16.1-283(B) and (C)(2). The mother argued that the trial court erred in admitting into evidence two internet generated documents because they were not properly authenticated and that there was insufficient evidence to support the termination decision. The appellate court first concluded that any error in the admission of the internet documents was harmless, because the information in the documents was cumulative of undisputed facts. The appellate court further concluded that the evidence was sufficient to support termination of the mother’s parental rights under Va. Code Ann. § 16.1-283(C)(2). The evidence showed that the mother, who considered herself an excellent parent, had been evicted from two different homes during the 12 months prior to the hearing for failure to pay her rent; the mother did not always have food in her home for the child during visitation; the mother struggled with mental health issues, including anxiety, depression, and bipolar disorder; the mother was sporadic in attending mental health counseling made available to her; and the mother was both the victim and perpetrator of domestic violence.
